Release of Liability, Waiver of Claims, and Assumption of Risk Agreement

Read Carefully, This Agreement Affects Your Legal Rights

This Release of Liability, Waiver of Claims, and Assumption of Risk Agreement (“Agreement”) applies to participation in any class, course, training session, skills session, demonstration, event, service, or activity provided, hosted, sponsored, taught, staffed, or arranged by Ready Rescuer LLC, a Minnesota limited liability company, including its owners, members, managers, officers, employees, instructors, contractors, representatives, agents, affiliates, successors, and assigns (“Ready Rescuer”).

This Agreement applies whether the activity takes place at a Ready Rescuer location, a rented or third-party classroom, a customer’s workplace, a school, a church, a public facility, a private residence, an event site, or any other training or service location.

By signing, checking an agreement box, registering for a course, attending a course, participating in training, or allowing a minor under my authority to participate, I agree as follows:

1. Activities Covered

  • CPR training;
  • AED training;
  • First aid training;
  • Basic Life Support (BLS) training;
  • babysitting and child safety training;
  • emergency response, safety, and preparedness training;
  • skills practice, skills testing, demonstrations, scenarios, and simulations;
  • use of manikins, AED trainers, first aid supplies, classroom equipment, training materials, and related equipment;
  • onsite, offsite, private, public, workplace, event, and group training sessions;
  • any related setup, instruction, evaluation, remediation, communication, or service activity.

2. Assumption of Inherent Risks

I understand and acknowledge that participation in Ready Rescuer activities may involve risks, including but not limited to:

  • physical exertion;
  • kneeling, bending, lifting, reaching, compressions, rescue breathing practice, or repeated physical movements;
  • soreness, strains, sprains, bruises, dizziness, fainting, fatigue, allergic reactions, illness, or personal injury;
  • contact with training equipment, cleaning products, classroom materials, manikins, AED trainers, first aid supplies, or other participants;
  • emotional discomfort from emergency scenarios, injury simulations, child safety topics, medical topics, or emergency response discussions;
  • slips, trips, falls, property damage, or injury at a training location;
  • risks related to travel, parking, weather, building conditions, third-party facilities, or customer-provided locations;
  • risks caused by my own actions, omissions, physical condition, health status, lack of attention, failure to follow instructions, or failure to disclose relevant limitations;
  • risks caused by other participants or third parties.

I understand that these risks may be present even when reasonable care is used. I voluntarily assume all known and unknown risks associated with participation in Ready Rescuer activities.

3. Responsibility to Determine Fitness to Participate

I am responsible for determining whether I, or any minor for whom I am signing, can safely participate in the activity. I understand that Ready Rescuer does not provide medical advice and does not determine whether participation is medically appropriate for me.

I agree to stop participating and notify an instructor or Ready Rescuer representative if I experience pain, dizziness, shortness of breath, illness, injury, distress, or any condition that may make continued participation unsafe.

I understand that reasonable accommodations may be available if requested in advance, but Ready Rescuer cannot guarantee that all requests can be accommodated in every class, location, or training format.

4. Agreement to Follow Instructions

I agree to follow all written, posted, verbal, and demonstrated instructions provided by Ready Rescuer, its instructors, staff, representatives, or facility personnel.

I understand that Ready Rescuer may remove a participant from a class or activity if the participant is disruptive, unsafe, impaired, threatening, harassing, refuses to follow instructions, misuses equipment, or otherwise interferes with the safety or delivery of the activity.

5. Release and Waiver of Claims

To the fullest extent allowed by Minnesota law, I voluntarily release, waive, discharge, and agree not to sue Ready Rescuer for claims, demands, damages, injuries, losses, liabilities, costs, or expenses arising out of or related to my participation, attendance, use of equipment, presence at a training location, or receipt of services from Ready Rescuer.

This release includes, but is not limited to, claims for personal injury, illness, death, property damage, economic loss, emotional distress, or other damages, whether caused by:

  • the inherent risks of the activity;
  • my own actions or omissions;
  • the actions or omissions of other participants or third parties;
  • conditions at any Ready Rescuer, customer-provided, rented, public, private, or third-party location;
  • use or misuse of training equipment, supplies, or materials;
  • Ready Rescuer’s own ordinary negligence, including the ordinary negligence of its owners, employees, instructors, contractors, representatives, or agents.

This Agreement is intended to release Ready Rescuer from liability for its own ordinary negligence to the fullest extent allowed by Minnesota law.

This Agreement is not intended to release, waive, or limit liability for gross negligence, willful or wanton misconduct, intentional misconduct, reckless misconduct, or any other claim that cannot legally be waived under Minnesota law.

6. Indemnification

To the fullest extent allowed by law, I agree to indemnify, defend, and hold harmless Ready Rescuer from and against any claims, demands, damages, liabilities, judgments, settlements, costs, expenses, or attorney fees arising out of or related to:

  • my participation in Ready Rescuer activities;
  • my failure to follow instructions;
  • my misuse of equipment;
  • my negligent, reckless, willful, or intentional conduct;
  • my inaccurate, incomplete, or misleading registration information;
  • claims brought by or on behalf of a minor, family member, invitee, employee, student, participant, or other person for whom I registered, authorized, supervised, or submitted information, to the extent allowed by law.

7. Damage to Property or Equipment

I agree to pay for loss, damage, excessive cleaning, or replacement costs caused by my negligent, reckless, willful, or intentional misuse of Ready Rescuer property, training equipment, rented equipment, facility property, customer property, or third-party property.

8. Emergency Medical Care

If I, or a minor for whom I am signing, appears to need emergency medical care, I authorize Ready Rescuer to contact emergency services. I understand that Ready Rescuer is not responsible for medical costs, ambulance fees, hospital costs, treatment costs, or related expenses.

I understand that Ready Rescuer instructors may be trained in emergency care but are not acting as my personal healthcare provider during a class or activity.

9. Minors

If I am signing for a minor participant, I certify that I am the minor’s parent or legal guardian, or that I otherwise have legal authority to agree on the minor’s behalf.

I agree to explain the nature of the activity and the importance of following instructions to the minor participant. I accept responsibility for the minor’s participation and agree to the terms of this Agreement on behalf of myself and, to the fullest extent allowed by law, on behalf of the minor participant.

10. Group Registration and Third-Party Registration

If I register, enroll, submit information for, or authorize participation by another person, employee, student, family member, group member, or attendee, I certify that I have authority to provide the information submitted and to receive class-related communications regarding that registration.

I understand that each adult participant may still be required to agree to Ready Rescuer’s applicable terms, policies, and releases directly. I also understand that a parent or legal guardian may be required to agree on behalf of a minor participant.

11. Accuracy of Information

I agree that all registration, roster, participant, contact, certificate, and course information I provide is accurate and complete to the best of my knowledge.

I understand that inaccurate, incomplete, or late information may result in delays, inability to issue course materials, inability to issue certification, rescheduling, removal from a class, or cancellation, subject to Ready Rescuer’s applicable policies.

12. Communications

I consent to receive class-related and service-related communications from Ready Rescuer, including emails, phone calls, text messages, calendar notices, reminders, invoices, receipts, course instructions, roster requests, certification-related messages, and follow-up communications related to the class, service, or order.

13. No Guarantee of Certification or Outcome

I understand that participation in a class does not guarantee successful completion, certification, employment qualification, licensure, workplace acceptance, regulatory compliance, or any particular outcome.

Certification, if applicable, may depend on attendance, participation, skills performance, testing, completion of required online learning, course prerequisites, instructor evaluation, certifying organization rules, and accurate participant information.

14. Third-Party Certifying Organizations and Materials

Some Ready Rescuer courses may involve third-party curriculum, certification standards, course materials, online learning platforms, or certifying organizations, including but not limited to the American Heart Association or the American Red Cross.

I understand that Ready Rescuer may be required to follow third-party rules, policies, prerequisites, attendance requirements, skills requirements, and certification standards. Ready Rescuer does not control all third-party systems, certification platforms, processing times, or policy requirements.

15. Personal Property

I am responsible for my own personal property. Ready Rescuer is not responsible for lost, stolen, or damaged personal items, except to the extent required by law.

16. No Duress and Opportunity to Review

I acknowledge that I have had a reasonable opportunity to review this Agreement before participating. I understand that I may choose not to participate if I do not wish to agree to this Agreement.

I understand that I may consult an attorney before agreeing to this Agreement.

17. Governing Law and Venue

This Agreement shall be governed by the laws of the State of Minnesota, without regard to conflict-of-law rules.

To the extent a dispute is filed in court, the parties agree that venue shall be in the state or federal courts located in Minnesota, unless another venue is required by applicable law.

18. Good-Faith Resolution of Disputes

The parties agree to attempt in good faith to resolve disputes arising out of or related to this Agreement through informal communication before filing a lawsuit, unless emergency legal relief is necessary or unless applicable law provides otherwise.

Nothing in this section prevents a party from pursuing claims in a court of competent jurisdiction.

19. Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

If a court determines that a provision is overbroad, the provision shall be limited or modified to the minimum extent necessary to make it valid and enforceable, to the extent allowed by law.

20. Entire Agreement

This Agreement is part of Ready Rescuer’s applicable legal terms and policies, which may include its Terms and Conditions, Privacy Policy, Refund and Cancellation Policy, Participant Agreement, and other applicable policies.

If there is a conflict between this Agreement and another Ready Rescuer policy, this Agreement controls as to release of liability, waiver of claims, assumption of risk, and indemnification, unless otherwise required by law.

21. Acknowledgment

I HAVE READ THIS AGREEMENT CAREFULLY. I UNDERSTAND THAT IT AFFECTS MY LEGAL RIGHTS. I UNDERSTAND THAT BY SIGNING, CHECKING AN AGREEMENT BOX, REGISTERING, ATTENDING, PARTICIPATING, OR ALLOWING A MINOR UNDER MY AUTHORITY TO PARTICIPATE, I MAY BE GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO BRING CERTAIN CLAIMS AGAINST READY RESCUER LLC.
